These Terms & Conditions (“Terms”) govern your access to and use of flowrighttankless.com (the “Site”) and any services provided by FlowRight Tankless (“FlowRight Tankless,” “we,” “us,” “our”). By using the Site, booking an appointment, or paying for services, you agree to these Terms.

    •    No physical location: We do not operate a public storefront or office and do not accept walk-ins. We are a mobile/field service provider.

2) Service area

 

We provide in-person services only within Utah County and the corridor between Utah County and Salt Lake City, Utah (including communities along I-15 between these areas). We may decline or cancel any booking outside this service area.

3) Services

 

We offer mobile services related to tankless water heaters (e.g., maintenance, flushing, and related work). We reserve the right to modify available services at any time.

    •    Site content is informational and may not reflect real-time availability or pricing.

    •    Third-party products/parts used during service remain subject to the manufacturer’s warranties and policies.

4) Quotes, pricing, and changes

    •    Any quote or estimate (online, phone, or on-site) is non-binding until we inspect the equipment and confirm the scope of work.

    •    If conditions differ from what was described or expected, price and scope may change. We will seek your approval before proceeding with material changes.

    •    Prices may exclude taxes, disposal fees, or permit fees (if applicable).

5) Booking, arrival window, and access

    •    Appointment times may be provided as arrival windows. Delays can occur due to traffic, weather, emergencies, or prior job conditions.

    •    An adult (18+) must be present to grant access, make decisions, and authorize work.

    •    You agree to provide safe, clear access to the work area, including access to water, gas, power, and drain points as applicable.

6) Cancellation, reschedule & no-show

 

You may cancel or reschedule by contacting us. If you cancel or reschedule with less than 24 hours’ notice or are not present at arrival, we may charge a reasonable service call/no-show fee to cover travel and scheduling costs.

7) Payments

    •    Unless otherwise agreed in writing, payment is due upon completion of services.

    •    We accept payment via our third-party payment processor (e.g., credit/debit). We do not store full card numbers.

    •    Late or declined payments may accrue reasonable collection costs and interest to the extent allowed by law.

8) Customer responsibilities (important)

 

To help ensure a safe, successful service, you agree to:

    •    Confirm the location and accessibility of the unit, shut-off valves, and drains.

    •    Ensure the area around the unit is cleared (e.g., ~3 feet of working space).

    •    Secure pets and inform us of any hazards (e.g., leaks, gas smells, mold, electrical issues).

    •    Understand that flushing or servicing may reveal pre-existing conditions (e.g., corrosion, brittle fittings, failing valves) that could result in leaks or component failure. We are not responsible for pre-existing conditions or failures unrelated to our workmanship.

9) Workmanship & third-party warranties

    •    We perform services with commercially reasonable skill and care consistent with industry practice.

    •    Manufacturer warranties (for any parts/equipment used) are provided by the manufacturer, not by us. We make no guarantees regarding third-party products.

    •    To the fullest extent permitted by law, we disclaim all implied warranties (including merchantability, fitness for a particular purpose, and non-infringement). Your statutory rights remain unaffected.

10) Limitation of liability

 

To the maximum extent permitted by law:

    •    We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use, or loss of data.

    •    Our total liability for any claim arising out of or relating to the Site or services is limited to the amount you paid to us for the specific service that gave rise to the claim.

 

Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the maximum extent permitted.

11) Health & safety; emergencies

 

If we discover an urgent safety condition (e.g., suspected gas leak, dangerous wiring, active water leak), we may pause or refuse service until the issue is resolved. In an emergency, call 911 and your utility provider.

12) Intellectual property (Site content)

 

All content on the Site—including text, logos, graphics, icons, and layout—is owned by or licensed to FlowRight Tankless and is protected by applicable laws. You may not copy, modify, or reuse Site content without our written consent.

13) Acceptable use (Site)

 

You agree not to misuse the Site, including by attempting unauthorized access, scraping, reverse engineering, or introducing malware. We may suspend or block access if misuse is suspected.

14) Communications consent

 

By providing your phone number or email, you consent to receive service-related communications (e.g., scheduling, updates, receipts). You can opt out of marketing emails at any time; service-critical messages may still be sent.

15) Third-party links & tools

 

The Site may contain links to or integrate with third-party sites or tools (including payment processors). We do not control third-party content and are not responsible for their practices. Use of third-party services is subject to their terms.

16) Force majeure

 

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., severe weather, accidents, supply chain issues, utility failures, strikes, acts of government, or emergencies).

17) Governing law; venue

 

These Terms are governed by the laws of the State of Utah, without regard to conflicts of law. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Utah County, Utah for any dispute not subject to a different mandatory forum.

18) Dispute resolution (informal first)

 

Before filing a claim, both parties agree to try to resolve disputes informally in good faith by contacting the other party using the details above. If we cannot resolve the dispute within 30 days, either party may pursue available legal remedies.

19) Changes to the Terms

20) Severability & assignment

 

If a provision of these Terms is found unenforceable, the remaining provisions remain in effect. You may not assign your rights or obligations without our written consent; we may assign to an affiliate or in connection with a business transfer.

These Terms, together with any service order/estimate we confirm in writing and our Privacy Policy and Accessibility Statement, form the entire agreement between you and FlowRight Tankless regarding the Site and services.
